Настоящая статья посвящена проблеме правового регулирования обращения с животными безвладельцев. Автор статьи анализирует изменения, внесенные в профильное федераль ноезаконодательство, а также нормативные правовые акты субъектов РФ. Особое внимание уделяет сяюридической метафоре «экстраординарная ситуация», сформулированной Конституционным Су дом РФ и впоследствии включенной в региональное законодательство. По мнению автора, расшире ниедискреционных полномочий субъектов РФфактически привело к злоупотреблению правом и лега лизации умерщвления здоровых животных, что явственно следует из складывающейся судебной прак тики. Отдельно также рассмотрено квазинаучное понятие «немотивированной агрессивности», кото роенеобоснованно включено в текст закона

This article is devoted to the issue of the legal regulation governing the handling of owner less animals. The author analyzes the amendments introduced into the relevant federal legislation, aswell as the regulatory legal acts of the constituent entities of the Russian Federation. Particular attention is paid to the legal metaphor of an «extraordinary situation», asformulated by the Constitutional Court of the Russian Federation and subsequently incorporated into regional legislation. In the author’s opinion, the expansion of the discretionary powers of the Russian Federation subjects hasdefacto led to an abuse of right and the legitimi zation of culling healthy animals, a trend clearly evidenced by emerging judicial practice. The quasi-scientific concept of «unmotivated aggressiveness», which hasbeen unjustifiably included in the text of the law, is also examined separately
