<p>The article uses a historical and legal method to examine the evolution of the institution of suspension of preliminary investigation during the transition period from the Criminal Procedure Code of the RSFSR of 1960 to the Criminal Procedure Code of the Russian Federation of 2001. Itanalyzes the conceptual approaches proposed during the development of alternative drafts of the Criminal Procedure Code of the Russian Federation (1994, 1997, 2000). Itshows how the first draft (1994) proposed a radical reduction in the grounds for suspension, the second (1997) – the introduction of maximum time limits, and the third (2000) – a compromise model that retained traditional grounds butstrengthened procedural guarantees. The article examines the academic debates of the 1990s on the nature of suspension, time limits, and procedural guarantees, which clashed between supporters of the “search” concept (insisting on broad possibilities for suspension) and the “guarantee” concept (demanding time limits and judicial review). Particular attention is given to the transformation of the understanding of suspension: from a technical means of “freezing” an investigation, which allowed for an indefinite postponement of the investigation’s completion and often violated the rights of victims, to a procedural institution that ensures a balance between the public interest in solving crimes and the right of participants to a reasonable time for legal proceedings. Special attention is given to the evolution of the grounds for suspension: from three grounds in the 1960 Criminal Procedure Code of the RSFSR to an expanded list in the 2001 Criminal Procedure Code of the Russian Federation, including a temporary serious illness of the suspect (accused) and the submission of a request to the Constitutional Court of the Russian Federation. Proposals to introduce maximum suspension periods and discussions about the need to preserve the possibility of searching for the accused outside the framework of investigative actions are considered. The author concludes that during the drafting of the Criminal Procedure Code of the Russian Federation, a stable suspension model wasformed, based on the differentiation of grounds, limitation of investigative actions after the suspension, and strengthening of guarantees of the rights of participants (mandatory notification, the right to appeal). The design proposed in 2001 hasretained itsviability and continues to evolve in the modern context of digitalization of criminal proceedings, aswell asadapt to changes in the socio-political situation</p>
<kwd-group xml:lang="ru"><kwd>основания</kwd><kwd>сроки</kwd><kwd>институт</kwd><kwd>следователь</kwd><kwd>розыск обвиняемого</kwd><kwd>разумный срок</kwd><kwd>проекты УПК РФ</kwd></kwd-group><kwd-group xml:lang="en"><kwd>grounds</kwd><kwd>terms</kwd><kwd>institution</kwd><kwd>investigator</kwd><kwd>search for the accused</kwd><kwd>reasonable time</kwd><kwd>drafts of the Criminal Procedure Code of the Russian Federation</kwd></kwd-group></article-meta></front><back><ref-list><ref id="ref1"><mixed-citation publication-type="other" xml:lang="ru">Строгович М.С.
