В статье исследуется эволюция правового механизма привлечения к ответственности за уклонение от военной службы в период мобилизации. На основе судебной практики, законодательных инициатив 2022–2023 гг. и новелл 2024–2026 гг. выявлена трансформация правового регулирования: от уголовно-правовой репрессии к административно-цифровому принуждению. Обосновывается вывод о появлении гибридной модели ответственности, гдеуголовное преследование за уклонение от мобилизации заменено комплексом ограничительных мер. Научная новизна заключается в выявлении доктринального разрыва между традиционным пониманием уклонения и новым цифровым способом фиксации, а также в обосновании феномена «цифровой фикции уведомления»

The article examines the evolution of the legal mechanism for liability for evasion of military service during mobilization. Based on judicial practice, legislative initiatives of 2022–2023, and legal novelties of 2024–2026, the author identifies a transformation of legal regulation: from criminal lawrepression to administrative-digital coercion. The conclusion is substantiated that a hybrid model of liability hasemerged, where criminal prosecution for evasion of mobilization is replaced by a set of restrictive measures. The scientific novelty lies in identifying the doctrinal gapbetween the traditional understanding of evasion and the newdigital method of recording offenses, aswell as in substantiating the phenomenon of «digital fiction of notification»
