Настоящая статья посвящена вопросам исследования возможности привлечения к уголовной ответственности юридических лиц, которые не являются субъектами уголовной ответствен ности в Российской Федерации. Вместе с темопыт зарубежных стран (Франции, США, Китая, Велико британии) демонстрирует, что указанное возможно. Мы анализируем зарубежные примеры и приходим к выводу, что привлечение юридических лиц к уголовной ответственности является утопичным, по скольку юридическое лицо не обладает совестью, не способно к раскаянию, а исправительная цель наказания к нему неприменима. Введение такой ответственности позволит злоупотреблять правом посредством создания дополнительного субъекта, который кроме потери имущества в пользу госу дарства никак не несёт ответственности, и приведёт к тому, что правоохранительные органы переста нутзаморачиваться установлением конкретного виновника, ограничиваясь формальным признаком, что повышает риск обвинения честных людей

This article is devoted to the study of the possibility of bringing to criminal responsibility legal entities that are notsubjects of criminal responsibility in the Russian Federation. At the same time, the experience of foreign countries (France, USA, China, Great Britain) demonstrates that this is possible. Weanalyze foreign examples and come to the conclusion that bringing legal entities to criminal responsibility is utopian, since a legal entity does nothave a conscience, is incapable of repentance, and the correctional purpose of punishment is inapplicable to it. The introduction of such responsibility will allow the abuse of the right by creating an additional entity that, apart from the loss of property in favor of the state, is notresponsible in any way, and will lead to the fact that lawenforcement agencies will stop bothering to identify a specific culprit, limiting themselves to a formal sign, which increases the risk of accusing honest people
