Цель работы состоит в комплексном анализе вторичных санкций как формы экстерриториального регулирования и оценке их соответствия основополагающим принципам современного международного права. Рассматривается санкционный механизм США, анализируются существующие подходы к пределам осуществления государственной юрисдикции, а также соотношение вторичных санкций с принципами международного права. Анализируется позиция ООН и Европейского союза относительно допустимо стиподобных мер. Актуальность темы состоит в том, что в условиях последовательной эволюции санк ционного режима СШАанализ правовой природы вторичных санкций и их соответствия международ но-правовым стандартам приобретает особое значение для формирования позиций государств, при нятия имимерпротиводействия и выработки доктринальных подходов к квалификации подобных практик. Сделан вывод о том, что использование государствами механизма вторичных санкций препятствует формированию обычной нормы международного права, запрещающей экстерриториальное санкционное воздействие, и свидетельствует о нарастающей фрагментации международного права</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article analyses USsecondary sanctions as a distinct form of extraterritorial regulation lacking recognised grounds under international law. The aim of the study is to conduct a comprehensive anal ysis of secondary sanctions as a form of extraterritorial regulation and to assess their compatibility with the fundamental principles of contemporary international law. The USsanctions mechanism is examined, existing approaches to the limits of state jurisdiction are analysed, and the relationship between secondary sanctions and the principles of international law is considered. The positions of the United Nations and the European Union on the admissibility of such measures are assessed. The relevance of the topic lies in the fact that, against the backdrop of the continuous evolution of the USsanctions regime, the analysis of the legal nature of secondary sanctions and their compliance with international legal standards is of particular importance for shaping state positions, developing countermeasures, and elaborating doctrinal approaches to the qualifica tion of such practices.
