Актуальность темы обусловлена транснациональным характером рынка, отсутствием единообразного обязательного режима и процессуальными рисками, возникающими вследствие участия фандера: конфликтами интересов, ограничением автономии финансируемой стороны, вопросами раскрытия информации, конфиденциальности и распределения расходов. Цель исследования состоит в определении того, способны ли профессиональные кодексы и иные мягко-правовые инструменты сформировать достаточный режим регулирования, а также в обосновании оптимальной модели их соотношения с институциональными правилами и императивными нормами. Использованы формально-юридический, сравнительно-правовой и системно-структурный методы, а также отдельные элементы экономического анализа права. Установлено, что саморегулирование эффективно на стадии первичной стандартизации: оно позволяет закреплять требования к финансовой устойчивости фандеров, защите конфиденциальности, недопустимости произвольного прекращения финансирования и ограничению вмешательства в ведение дела. Вместе с тем добровольность участия, отсутствие универсальных санкций и структурный конфликт между коммерческим интересом фандера и процессуальной автономией стороны исключают самодостаточность этой модели. Обосновано, что мягкое право должно выполнять функцию первичного нормообразования, арбитражные регламенты – процессуальной конкретизации, а ограниченное жесткое право – закрепления минимальных гарантий прозрачности, добросовестности и защиты публичного интереса. Научная новизна состоит в рассмотрении саморегулирования не как конечной альтернативы законодательству, а как стадии нормативного цикла, на которой профессиональные стандарты проходят апробацию и подготавливаются к институциональному закреплению.</p></abstract><abstract xml:lang="en" abstract-type="summary"><p>The article examines the regulatory potential and inherent limits of self-regulation in the third-party funding market in international arbitration. The topic is relevant because this transnational market lacks a uniform mandatory regime, while funder involvement may generate procedural risks concerning conflicts of interest, the funded party’s autonomy, disclosure, confidentiality and allocation of costs. The study determines whether professional codes and other soft‑law instruments can form a sufficient regulatory framework and substantiates their optimal relationship with institutional rules and mandatory law. It applies formal legal, comparative and systems methods, as well as law‑and-economics analysis. It finds that self-regulation is effective at the stage of initial standardisation: it can establish requirements concerning funders’ financial soundness, protection of confidential information, restrictions on arbitrary termination of funding and limits on interference with case management. However, voluntary participation, the absence of universal sanctions and the structural tension between the funder’s commercial interest and the funded party’s procedural autonomy prevent self-regulation from being a self-sufficient model.
